Customer's Right of Withdrawal

1. The right of withdrawal is recognized only for the products provided for in articles 52 et seq. of Legislative Decree no. 206 of September 6, 2005.
2. For products for which the right of withdrawal is not excluded, the Customer has the right to withdraw from the stipulated contract, without any penalty and without specifying the reason, within a period of 14 (fourteen) days, starting from the day of receipt of the purchased product, by using the withdrawal form available here and sending the completed form to the e-mail gin@floriservizio.it or by submitting any declaration from which the intention to withdraw from the contract clearly emerges, including via certified email, or registered letter with return receipt.
3. To comply with the withdrawal period, it is sufficient to send the communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period. The burden of proof relating to the exercise of the right of withdrawal, in accordance with this article, lies with the Customer.
4. The goods must be returned without undue delay and in any case within 14 (fourteen) days from the date on which the Customer communicated their decision to withdraw from the contract to the Seller.
5. The right of withdrawal in favour of the Buyer is in any case excluded in the cases expressly provided for by art. 59 of Legislative Decree no. 206/2005 and in particular for:  

• Products made to measure or clearly personalized;
• the supply of Products that are liable to deteriorate or expire rapidly; and for
• the supply of sealed goods which are not suitable for return for health protection or hygiene reasons and were unsealed after delivery. In the case of the sale of Products in bottles, the opening of even just one of the supplied bottles entails the loss of the right of withdrawal, as opened bottles cannot be returned for hygiene reasons.

6. The Customer who exercises the right of withdrawal in accordance with this article shall bear the direct costs of returning the goods to the Seller, unless otherwise agreed between the Seller and the Customer.
7. The Customer who exercises the right of withdrawal will be reimbursed the sums already paid, including delivery costs, with the exception of additional costs resulting from the type of delivery expressly chosen by the Customer and different from the least expensive type of standard delivery offered by the Seller. These sums will be reimbursed within 14 (fourteen) days, starting from the day on which the Seller was informed of the Customer's decision to withdraw from the contract, using the same means of payment used by the Customer for the initial transaction, unless the Customer has expressly agreed otherwise. The Seller is entitled to suspend the reimbursement until they have received the Products or have received proof from the Customer that the Products have been sent back, whichever occurs first. 
8. To be entitled to a full refund, the Products must be returned intact and in their original packaging. The Customer is only entitled to use the Products for the purpose of verifying whether they conform to the description provided. With express reference to art. 5., it is excluded that the legitimate verification referred to in this paragraph may also include the opening of bottles supplied by the Seller. The Customer is responsible for any loss of value of the Products due to a use of the Products that exceeds the legitimate use described in this paragraph. In this case, the Seller has the right to apply a proportionate deduction from the amount to be reimbursed, which takes into account the loss of value as described above.
